Terms of service

The rules of the service in plain language: trial, pricing, cancellation and your clients' data.

Last updated: October 29, 2026

The short version. Kuseki is a business service, not a consumer product. 7-day free trial, no card. Launch price USD 9.99 a month (EUR 9.90 a month or EUR 99 a year), locked while you stay subscribed. Cancel any time from your dashboard. No commission on bookings. Your clients are your clients; we handle their data only on your behalf.

1. Who we are and what these Terms cover

These Terms govern the use of Kuseki App (kuseki.app), provided by Michele De Vivo, trading as MichyDev, a self-employed professional based in Spain ("Kuseki", "we", "us"). Contact: [email protected]. Tax ID (NIF) Y4961075N. By creating an account you accept these Terms.

2. What is Kuseki?

Kuseki gives you a personal booking page with a link you can share (Instagram bio, WhatsApp, Google and so on). Clients pick a service, day and time; you get the booking in your dashboard. Kuseki is not a marketplace: clients only see you. We may improve and change features over time without removing the core features of the plan you pay for.

3. Who can use Kuseki?

Kuseki is built for professionals and businesses who use it for their work. By creating an account you confirm you are at least 18 and are acting for your business, not as a consumer. You are responsible for the accuracy of what you enter and for keeping your password safe.

4. How does the free trial work?

5. Pricing and billing

If we change prices for active subscriptions (other than locked ones), we email you at least 30 days in advance and you can cancel before the new price applies.

6. Cancellation and refunds

7. Acceptable use

You agree not to:

For serious breaches we may suspend your account, with notice whenever possible.

8. Your clients, your responsibility

The relationship with your clients is yours. You set services, prices, hours and cancellation rules, and you are responsible for the services you provide. For your clients' data you are the controller: you must tell them how you use their data (a short notice on your page works, and we help you write it) and follow the rules that apply to you, including rules on marketing messages and texts.

9. Processing data on behalf of the professional (Article 28 GDPR agreement)

This section is the data processing agreement between you (controller) and Kuseki (processor) under Article 28 of the EU General Data Protection Regulation (Regulation 2016/679).

10. WhatsApp reminders

WhatsApp reminders are an optional feature, coming soon. When available, they are sent only if you turn them on, through Meta's WhatsApp Business services and under WhatsApp's rules. Any cost will be shown clearly before you activate it. If you text clients in the US, you are responsible for following the consent rules that apply to texts and calls.

11. AI assistant

If the site or dashboard shows a chat with an AI-based assistant, we label it clearly (Article 50 of the EU AI Act). The assistant's answers are guidance and may contain mistakes; for important matters (invoices, contracts, data) what we confirm by email prevails.

12. Availability

We work hard to keep Kuseki online, but we cannot promise uninterrupted service. There may be maintenance or provider outages. When we can, we announce planned maintenance in advance.

13. Content and intellectual property

Content you upload (logo, photos, text) stays yours. You allow us to use it only to show your page and run the service. The software, the Kuseki brand and the site design belong to the provider.

14. Limitation of liability

To the extent the law allows:

15. Changes to these Terms

We may update these Terms. For important changes we email you at least 30 days in advance. If you do not agree, you can cancel before they take effect.

16. Governing law and venue

These Terms are governed by Spanish law. Disputes go to the courts of the provider's domicile in Spain. Any mandatory protections that apply to you by law are not affected.

The EU Online Dispute Resolution (ODR) platform was discontinued on July 20, 2025 by Regulation (EU) 2024/3228, and it only covered consumer contracts anyway, while Kuseki is a business-to-business service. If something goes wrong, write to us first: we would rather fix it by talking.
